Lift Expert Witness Instructions

Expert Witness Case 1
Case 1 – Engineer Injured – Expert Report involving Engineer who was severely injured by falling down a lift shaft. Damages awarded to Engineer.
Key points highlighted by the Judge in their summary – The lift contractor’s failure to provide suitable Risk Assessment and Method Statements in carrying key elements of the work.
Expert Witness Case 2
Case 2 – Lift user injured – A person when entering the lift tripped and fell into the lift used by the general public. This resulted in an injury to their shoulder and hip.
Key points highlighted by the Judge in their summary – The lift owner failed to provide suitable Risk Assessment, which would have highlighted the lift’s existing car levelling system was classified as high risk. The incident occurred some years after the risk assessment was introduced and therefore the client was found not to have taken reasonable steps in improving the lift levelling system.
